Types of Power of Attorney in the United Arab Emirates

A power of attorney is a formal authorization granted to a person (the agent) to represent another person (the principal) and to carry out specific tasks or transactions on their behalf. In the UAE, powers of attorney vary based on their purpose, duration, and scope of authority, and must be officially notarized by a public notary to ensure their legal validity.

  1. General Power of Attorney

Granted to provide broad authority in managing the principal’s affairs, including financial, real estate, banking, and administrative matters. It usually does not include the power to sell unless explicitly stated.

  1. Special Power of Attorney

Granted for specific purposes or transactions, such as selling a property, representing the principal before a government authority, or receiving documents.

  1. Legal Representation POA

Granted to a lawyer to represent the principal before courts and judicial authorities, in civil, criminal, or Sharia cases.

  1. Management POA

Used to authorize someone to manage the principal’s assets, such as leasing properties or overseeing investments, without granting authority to sell or dispose of the property permanently. The scope of authority is clearly defined.

  1. Transactional POA

Grants authority to carry out specific transactions such as the sale of property or movable assets.

  1. Marketing Agency POA

Granted to an entity for marketing the principal’s products or services under defined terms, often used in commercial contexts to ensure effective promotion.

  1. POA for Representation Before Official Authorities

Used to complete specific transactions before various government entities such as the Land Department, Immigration, Municipalities, or the Ministry of Human Resources.

  1. Temporary or Conditional POA

Granted for a limited period or contingent on a specific event (e.g., travel or absence of the principal), and it terminates upon expiry or fulfillment of the condition.

  1. Commercial Agency POA

Regulated by the UAE Commercial Agencies Law, this type of POA is granted to a company or agent to distribute or sell products in the country on behalf of a foreign company.
